An Act to support individuals with developmental disabilities

Calls for Executive Office of Health & Human Services, Department of Public Health, and Office of Medicaid to improve access to high-quality health care and eliminate health care disparities among disability populations. Areas of focus will include care coordination, disability education requirements and cultural competence for professional licensure and renewal.

Facilitates inter-agency communication by creating an online database that tracks how many individuals with developmental disabilities apply for services, receive services, and apply but are denied services.  DDS, Mass Rehab, Mass Commission for the Blind, Mass Commission for the Deaf and Hard of Hearing and other agencies will all be required to submit their data annually to this central location and an annual report will be prepared after all data is submitted.

An Act to support the transition to adult services for persons with disabilities

Expands transition (Turning 22) services and supports to students with disabilities “without adult service agency ties” (688 process). It also updates and expands the types of “habilitative services” that must be provided under the 688 process. It assigns to EOHHS the obligation to monitor and collect data on the extent to which needed 688 services are not being provided, because of shortfalls in appropriations.

An Act prohibiting discrimination against adults with disabilities in family and juvenile court proceedings

Prevents children of parents with disabilities to be inappropriately removed from their homes or separated from their parents based on disability alone and without a determination of how the parent’s disability affects their ability to parent.
